The verdict came from a court observation following a verdict by video conference.  There has been an irregularity in the counting of ballot papers.  Irregularities have occurred so the election has been ordered to be canceled.  The election official has also been negligent.

It may be mentioned that the Gujarat Assembly elections held in 2017 were won by the present state Education Minister Bhupendrasinh Chudasama by a narrow margin defeating the Congress candidate.  However, an application challenging Bhupendrasinh Chudasmani's victory was filed in the High Court.  The petition was filed alleging irregularities in the election.

What's the matter

In the 2017 Gujarat Assembly elections, BJP candidate Bhupendrasinh Chudasama won the Dholka seat by just 327 votes.  The whole controversy arose when the ballot paper was not counted in the counting of votes.  In this case, Congress candidate Ashwin Rathore had complained that the 429 votes on the ballot paper which were in his favor were not taken into account.

According to the rules of the Election Commission, there is a provision to count the ballot papers before counting the votes of EVM.  However, this rule was set aside and the direct vote of EVM was counted.  When there was a code of conduct, Dhawal Jani was appointed in place of Gaurang Prajapati as Deputy Collector for the purpose of benefiting Bhupendra Chudas.
